Xinhua News Agency, Beijing, February 5th the State Council recently approved an investigation report on the special major fire and explosion accident at the dangerous goods warehouse of Ruihai Company on the "8·12" incident in Tianjin Port. According to a survey conducted by the investigation team of the State Council, the fire and explosion accident at the dangerous goods warehouse of Ruihai Company at Tianjin Port “8·12” was a particularly serious responsibility for production safety responsibility.
On August 12, 2015, a fire and explosion accident occurred in the dangerous goods warehouse of Ruihai International Logistics Co., Ltd. in Tianjin Port, Tianjin Binhai New Area, killing 165 people (including 110 public security firefighters involved in rescue operations, accident companies, and surrounding enterprises Employees and residents 55 people) and 8 people were missing (including firefighters in Tianjin Port 5, employees in surrounding companies, and firefighters in Tianjin Port 3), 798 injured (58 injured and heavy wounded, minor injuries 740 people).
After the accident, the Party Central Committee and the State Council attached great importance. General Secretary Xi Jinping made two important instructions and presided over the convening of the Standing Committee of the Political Bureau of the Central Committee to listen to reports on accident rescue and emergency response. Premier Li Keqiang repeatedly made important instructions and led relevant comrades to visit the scene of the accident to guide the rescue and disposal work. He presided over the State Council Standing Committee to conduct research and deployment. The other leading comrades of the State Council have specifically directed Tianjin to carry out disposal work and prevent secondary disasters. On August 18, 2015, with the approval of the State Council, a State Council investigation team composed of the Ministry of Public Security, the General Administration of Security Supervision, the Ministry of Supervision, the Ministry of Transport, the Ministry of Environmental Protection, the All-China Federation of Trade Unions, and the Tianjin Municipality was established to invite the highest people. The Procuratorate dispatched personnel to participate in the investigation and hired experts from the fields of explosion, firefighting, criminal investigation, chemical engineering, and environmental protection to participate in the investigation.
The investigation team adhered to the principle of "Strict Science, Practicality, Law and Regulation, and Safety and Quality", successively accessed more than 1,200 texts, more than 6 million words, acquired 100,000 hours of surveillance video, and investigated and collected more than 600 relevant personnel one by one. Through repeated on-site inspections, testing and appraisal, investigation and evidence collection, simulation experiments and expert demonstrations, the accident passing, causes, casualties and direct economic losses were identified, the nature and responsibilities of the accidents were identified, and the responsible units and responsibilities were put forward. The personnel’s handling suggestions analyzed the outstanding issues and lessons revealed by the accident and put forward suggestions for strengthening and improving the work.
The investigation team found that the direct cause of the accident was the local drying of the nitrocellulose in the container on the south side of the arrival area of the dangerous goods warehouse of the Ruihai company due to the loss of the wetting agent, accelerating the liberation of heat under the action of high temperature (weather) and other factors, and accumulating spontaneous combustion caused nitrocellulose and other dangerous chemicals in adjacent containers to burn over a long period of time, resulting in the explosion of dangerous chemicals such as ammonium nitrate stacked in the arrival area.
The investigation team determined that Ruihai Company has committed serious violations of laws and regulations and is the main responsible unit for the accident. The company severely violated the Tianjin City Master Plan and the Binhai New Area's controlled detailed plan, ignored the responsibility of the main body of safe production, illegally built dangerous goods yards, and violated laws and regulations in modern logistics and general storage areas from November 2012 to June 2015. The change of qualification management and storage of dangerous goods, security management is extremely chaotic, resulting in a long-term existence of a large number of security risks.
At the same time, the investigation team determined that the accident also exposed problems such as the existence of non-compliance, lack of enforcement, and weak supervision in local governments and departments. Tianjin Transportation, Port, Customs, Safety Supervision, Planning and Land, Market and Quality Inspection, Maritime, Public Security, and Binhai New Area Environmental Protection, Administrative Approval, etc., did not earnestly implement relevant laws and regulations, did not earnestly perform their duties, and violated laws and regulations. Administrative licenses and project reviews were conducted, and the daily supervision was severely lacking; some responsible persons and workers were greedy and abused their powers. The Tianjin municipal party committee, the municipal government, and the Binhai New Area district committee and district government have not fully implemented the relevant laws and regulations, and have overseen the failure of relevant departments and units to violate urban planning behavior and problems in safety production management. As the competent authority for port dangerous goods supervision, the Ministry of Transport has not supervised and inspected the dangerous goods safety management of ports in accordance with the statutory responsibilities, and has failed to provide guidance for the work of the Tianjin Transportation System. The General Administration of Customs urges and guides the work of Tianjin Customs not in place. Relevant intermediaries and technical service organizations are falsified and guilty of breaching laws and regulations for safety review, evaluation and acceptance.
The public security and procuratorial organs filed investigations on 49 enterprise personnel and administrative supervision targets according to law and adopted criminal compulsory measures. Among them, the public security organs filed investigations against 24 related enterprise personnel in accordance with laws and adopted criminal compulsive measures (13 from Ruihai Company, 11 from intermediary and technical service institutions); the procuratorial organs filed investigations against 25 administrative supervisors according to law and adopted criminal compulsory measures. (2 persons at the main hall level, 7 at the deputy department level, 16 at the department level), of which 9 are in the transportation department, 5 in the customs system, 5 in Tianjin Port (Group) Co., Ltd., 4 in the safety supervision department, and 2 in the planning department. .
Based on the accident investigation and the determination of accident liability, the investigation team also put forward a handling opinion on 123 responsible personnel. It recommended that 74 responsible personnel should be given party and government discipline, including 5 provincial and ministerial level, 22 bureau level, and county level.22 people, 25 people at or below the division level; for the other 48 responsible personnel, it is recommended that the Tianjin Municipal Commission for Discipline Inspection and other relevant departments should, as the case may be, talk or criticize and educate; one responsible person died during accident investigation and treatment, and it is recommended not to give it anymore disposition.
Pursuant to the "Safety Production Act" and other laws and regulations, the investigation team proposed to revoke Ruihai Company's relevant licenses and impose fines. The relevant principals of the company shall not be responsible for the production and business units of the industry for the rest of their lives; China Binhai Sheng Security Evaluation Company, Tianjin City Intermediary and technical service agencies such as chemical design institutes impose administrative penalties such as confiscation of illegal income, fines, and revocation of qualifications. The investigation team also recommended that the Tianjin municipal party committee and the municipal government be subject to public criticism and instructed the Tianjin municipal party committee and the municipal government to make a profound inspection of the party Central Committee and the State Council; and the Ministry of Transport was instructed to make a profound inspection to the State Council.
In response to the problems exposed by the accident, the investigation team put forward ten preventive measures and recommendations, namely: adhere to the safety first principle, effectively put the safety production work in a more prominent position; promote the production and business units to implement the main responsibility of safe production Any enterprise shall not illegally change its business qualifications; further rationalize the port safety management system, clarify the safety supervision duties of the relevant departments; improve the rules and regulations, focus on improving the legalization of dangerous chemicals safety supervision, and establish and improve the safety chemical supervision system Improving laws, regulations, and standards systems; Establishing a unified national regulatory information platform to strengthen the supervision and control of hazardous chemicals; Strictly implementing the city's overall plan, and strictly admitting conditions for safe access; Vigorously strengthening the building of emergency rescue forces and special equipment to improve production safety Emergency response capabilities; strict supervision of safety agencies, environmental impact assessments and other intermediaries to regulate their business practices; focus on hazardous chemical safety special campaigns to eliminate all types of safety hazards.
In addition, the investigation team also found that this accident caused varying degrees of pollution to the atmospheric environment, water environment, and soil environment in the central area of the accident and surrounding areas. The quality of the marine environment in Bohai Bay, Tianjin, has not been affected. There are no cases of poisoning and deaths due to environmental pollution. At present, the impact on the atmospheric environment has been basically eliminated. Contaminated surface water is effectively disposed of. The soil and groundwater in the center of the accident are undergoing classified treatment and repair. With regard to the medium and long-term environmental and personnel health impacts that may be caused by accidents, relevant parties are conducting continuous monitoring and evaluation and taking preventive measures.
